Terms of service
Version 1.0 · effective 2 August 2026
This is a courtesy translation. In the event of any discrepancy, the Polish version prevails.
§ 1. General
These Terms set out the rules for the supply of services by electronic means through the website biurokontraktu.pl (the "Website") and the panel at panel.biurokontraktu.pl (the "Panel"). The Website and Panel are also reachable at the earlier addresses in the asystentprojektu.pl domain.
The service provider is ContaPlug Jacek Augustyn, ul. Estreicherów 19, 30-225 Kraków, Poland, tax ID (NIP) 6771747651, email: biuro@biurokontraktu.pl, trading as Biuro Kontraktu (the "Provider").
The processing of personal data is described in the Privacy policy.
§ 2. Definitions
- Company — the business for which an account in the Panel is maintained.
- User — a natural person using the Panel on behalf of the Company.
- Account — the Company's account in the Panel, opened using a tax identification number.
- Generator — the free tool in the Panel for preparing material submittals.
- User Content — forms, documents and other materials uploaded to the Panel or sent through the contact form.
§ 3. Nature of the services
The Panel is intended for businesses and serves purposes directly connected with their business activity (managing construction contract documentation). Services described on the Website but outside the Panel (ongoing contract support, letters, contract reviews) are supplied under separate agreements and quotations — these Terms do not cover them.
The Provider's services do not constitute legal assistance or legal representation; where a matter requires a lawyer, the Provider works with law firms at the client's instruction.
§ 4. Technical requirements
To use the Website and the Panel you need a device with internet access, an up-to-date web browser and — for the Panel — an active email address. The Panel supports the file formats indicated in its interface (in particular submittal forms in DOCX and product documents in PDF/JPG), within the size limits shown at the upload fields. Supplying unlawful content is prohibited.
§ 5. Contact form and initial review
Sending the form on the Website is voluntary and free of charge and does not constitute a contract. The free initial review of the documents sent is indicative and non-binding — it serves to establish whether and how the Provider can help, and to present a quotation. Paid services are supplied only after being separately ordered and the quotation accepted.
§ 6. Account in the Panel
- An Account is opened by providing a tax identification number; the Company's registry details are retrieved automatically from public registers.
- The person opening the Account represents that they are authorised to act on behalf of the Company.
- The Account holder may invite further Users; only invited persons have access to a project's data.
- Users must protect their login credentials and not share them with unauthorised persons; any suspicion of unauthorised access must be reported to the Provider without delay.
- The contract for the supply of services by electronic means is concluded when the Account is opened and these Terms accepted; it is concluded for an indefinite period.
§ 7. The Generator
- The Generator is supplied free of charge — no fees and no obligation to provide payment details.
- The Generator assists in preparing documents from the forms and materials supplied by the User; its output requires verification by the User before being used on a project.
- The Provider does not warrant that a document generated from the User's materials will satisfy the requirements of any particular employer or contract — responsibility for the content of documents submitted rests with the Company.
- Prompts regarding document completeness are advisory and do not replace the requirements of the specification or the instructions of the site supervision.
§ 8. User Content
- The User retains all rights to User Content.
- The User represents that they are entitled to use the forms and documents they upload to the extent needed to use the Panel.
- The User grants the Provider a free, non-exclusive licence to use User Content solely to the extent necessary to supply the services (storage, processing, document generation, backups).
- User Content is isolated from other Companies' data and is not shared with third parties, unless disclosure is required by law.
§ 9. Processing of personal data on the Company's behalf
Where User Content contains personal data, the Company remains its controller and the Provider processes it as a processor — solely for the purpose and to the extent necessary to supply the Panel services, for as long as the Account exists. The Provider: ensures confidentiality, applies appropriate technical and organisational measures (encryption in transit, access control, data isolation, backups), assists the Company in meeting its obligations towards data subjects, and after deletion of the Account removes the data from production systems. The Provider may use further processors for technical infrastructure (hosting, email); a list is available on request to the Provider's email address.
§ 10. Availability and development of the services
The Provider makes every effort to keep the Website and Panel running without interruption, but reserves the right to technical breaks — announced in advance where possible. The scope of free functions may be changed or withdrawn; the Provider will give at least 30 days' notice (in the Panel or by email) of any material restriction or discontinuation of a free service, allowing User Content to be downloaded.
§ 11. Liability
- The Company is responsible for the content of documents submitted on its projects, including those based on the output of the Generator, and for keeping copies of the originals of the materials it uploads.
- In respect of free services, the Provider is liable only for damage caused intentionally.
- The Provider is not liable for the consequences of false data being provided, of login credentials being shared with third parties, or for interruptions caused by force majeure.
§ 12. Complaints
Complaints about the operation of the Website or the Panel may be sent to biuro@biurokontraktu.pl, stating: the company and contact details, a description of the problem and — where possible — the date and circumstances in which it arose. We deal with complaints within 14 days of receipt; the response is sent to the complainant's email address.
§ 13. Ending use of the services
The Company may stop using the Panel and request deletion of the Account at any time (by email or from within the Panel). The Provider may terminate the contract or block an Account in the event of a material breach of these Terms — in particular supplying unlawful content, attempting to breach security, or acting to the detriment of other users — after first calling for the breach to cease, unless the nature of the breach justifies immediate blocking.
§ 14. Changes to these Terms
The Provider may amend these Terms for good reason (a change in the law, a change in the scope of services, security considerations). Panel users will be notified of changes in the Panel or by email at least 14 days before they take effect. If you do not accept the changes you may delete your Account before that date; continued use of the Panel after the changes take effect constitutes acceptance.
§ 15. Final provisions
These Terms are governed by Polish law. Disputes with Companies are subject to the jurisdiction of the court competent for the Provider's registered office. The invalidity of any single provision does not affect the validity of the remainder. The current version of the Terms is always available on the Website at biurokontraktu.pl/regulamin/.
